Total people in renting party: 1 not to exceed 4.

Rental period begins at 4 pm on 28-08-2021 and ends at 11 am on 08-09-2021.

SHORT TERM RENTAL CONTRACT:

WHEREAS I.- That RAFLEY COSTA DEL SOL , S.L.CIFB93442549, (hereinafter called the Advertiser) has been appointed to manage the letting of the property object of the current contract, by virtue of the contract signed with the Landlord. The information of the property object of the current contract is below:Banderas Celére located at Calle Mar De Alboran 70
Casa Banderas, E21B Mijas Andalucia licence #CTC_2020111522 in good condition and equipped with furniture and basic services, of which descriptions and pictures may be found on the referenced website The property is clean, in running order, all the basic services offered are in good condition. II - Both parties agreed to arrange the seasonal lease of the property described previously, so the present contract is established, governed by the clauses listed below:

CLAUSES:FIRST- OBJECT: The Landlord leases for a period that will be established to the Tenant Party, who accepts the described property with the furniture and services, for a total of 1 people, including children. The current lease constitutes a Seasonal Lease intended for holidays, as intended by the article 3.2 of the Urban Leases Act (Ley de Arrendamientos Urbanos in Spanish) 29/1994, and under no circumstances or situations, the lease of the object of this contract will be used on a regular basis.SECOND.- DURATION: This contract is issued for a period of  11 days, from 16:00 pm on 28-08-2021 and will end automatically without prior notice, at 11 am on 08-09-2021, and the Tenant Party will have to hand over the keys to the Landlord or agent of the Advertiser. The obligation to reserve the Property will cease, losing the advance payment, when it is not occupied within the next 12 hours of the day established, unless the client confirms their arrival within this period and they come before the fee of the lease for the days elapsed has exceeded the amount of the advance payment. The Tenant Party will be required to leave the property in the state they found it, free from personal effects, with all services in running order and all the furniture and belongings in place, without the option of an extension unless otherwise agreed between both parties.THIRD.- PRICE OF THE LEASE AND PAYMENT METHODS. Short Term Rental Agreement Payment Policy: The price of the lease is indicated in the quote and depends on the website where the booking is made.The amount is payable as described below: A deposit equal to 25% of the rent is due on making the reservation. Final payment is due 30 days prior to arrival* (Except *, ** stated below). Visa, Mastercard, Discover, American Express, bank transfer and checks are all acceptable forms of payment. In cases of payment by check, all funds shall be made payable to Rafley Costa del Sol SL, with a notation of your confirmation number written on your check. Reservations that are not paid in full by the final payment date will be cancelled and advance payment forfeited. A Security Deposit is required for each reservation.*On selected properties, a guest may be offered the option to pay the remaining part of the payment upon arrival.  Where a guest chooses this option, the following terms and conditions apply: The second payment should be made upon arrival to the office to Rafleys Costa del Sol manager.**Airbnb and Tripadvisor bookings. Reservations that are not paid in full before entering the property will be cancelled and advance payment forfeited. Short Term Cancellation Policy: If the Tenant Party cancels the reservation there is a penalty that depends of the number of remaining days before the start of the lease period: Less than 30 days: 100% of the advance payment The cancellation needs to be notified in writing. The cancellation date is the date when the document is received by the Advertiser. If the Tenant ends their stay before the departure date for any reason, they are expected to pay the entire price agreed for the lease. Check – In Time : Check in time is after 4:00 P.M.In case of late check in no refund will be issued Note: Check in begins at listed times, but cannot be guaranteed. During low season check in and check out time might be subject to availability and occur before 16:00 if agreed between both parties. Property must be clean and inspected prior to occupancy. Check – Out time: Check out time is at 11 am.In case of early leave no refund will be issued. Responsibilities: Upon checkout, we ask our guests to leave their property in the same general condition as it was found. Departure responsibilities including the following: leaving clean dishes, putting them away, disposing of all trash in proper street side containers, locking all doors and windows, returning keys to Rafleys Costa Del Sol rep. Failure to comply with these responsibilities may result in additional charges to the guest. Rental Occupancy and Age Requirements: Each property indicates the number of occupants allowed in a property at any one time. Guest agrees to keep the number of people occupying the premises at/or under the maximum persons allowed. The individual making the reservation must be 25 years of age or older and must occupy the rental property the entire term of the reservation. Any breach of the above policies will result in termination of this agreement, including possible eviction of the property and possible forfeiture of any monies paid. Behaviour Requirements:  There are certain rules, common sense based, regarding behavior that the Guest agrees to comply with. Please avoid making noise at late hours, (also at siesta hours),  be polite with the neighbours, leave the surroundings and the common areas clean and free of rubbish, water or damage, comply with the rules of the community and follow the swimming pool rules. Please read the instructions to make sure all the recommendations from the Landlord are acknowledged. Making fire is totally forbidden in Spain during the summer. The police might be involved in case any of these points are violated, keeping the Landlord the right to evict the whole party from the apartment. Smoking Policy: This property is NONSMOKING. Any breach of this policy will result in termination of this agreement, including possible eviction of the property and forfeiture of any monies paid. Guest will also be responsible for the additional cleaning charges. Agents Right of Entry:. In case of emergency, the Landlord or agents of Rafleys Costa del Sol may enter the residence at any time and without advance notice.Indemnification: Guest hereby agrees to indemnify and hold Rafleys Costa del Sol and the Landlord of the property not liable  for injuries or other losses to guest and other persons and property that may occur in connection with guest's use of the property. Guest further agrees that Rafleys Costa del Sol is not under any obligation to accept for safekeeping any moneys, securities, jewelry or other articles of personal property belonging to the guest, nor is Rafleys Costa del Sol or Landlord liable for any loss in connection with any such items, or for providing security for the property. Rafleys Costa del Sol will cooperate in forwarding any complaint or concern of guest to the Landlord of the property, but shall not be obligated to correct any condition or hazard associated with the property.Damages: Please report any damage upon arrival by calling Rafleys Costa del Sol. Also, please report any damage or breakage upon occurrence, so the matter can be settled prior to your departure. Inspection crews carefully check properties and you will be held responsible for damage beyond normal wear and tear.Property Rules: Hereby acknowledge that guest will not be entitled to any refund for any inoperable appliances, to include by way of example only, television, air conditioner, hot tub, or pool.Comparable Premises and Force Majeure: Unforeseeable circumstances may arise, which make it impossible for the Landlord to provide the anticipated accommodations to guest. Such circumstances may include, but not limited to, scheduling problems, equipment failure, as well as a fire, other casualty at the property. In such a circumstance, Rafleys Costa del Sol reserves the right to transfer guest to another vacation property of reasonably comparable value, determined in the sole discretion of Rafleys Costa del Sol whose determination shall be final.Tenant will have the right to reject the offered alternative, making a cancellation of the reservation with no penalty before any use of the alternative property. In other circumstances such as acts of war, acts of terrorism, hurricanes, wind storms, fires or other natural occurrences, circumstances not being exclusive, it may be impossible or impractical for Rafleys Costa del Sol to make available reasonable or other alternative accommodations to guest. In such a circumstance, Rafleys Costa del Sol shall return 100% of the payments received from the Tenant.Rate Change: Rates, descriptions, furnishings, association/resort fees and availability are subject to change WITHOUT NOTICE.Waiver of terms: No waiver or any breach of any of the terms of this agreement shall be permitted.Governing Law: This agreement shall be governed and enforced according to the laws of Spain. The prevailing party in any lawsuit to enforce any provisions of this agreement shall be entitled to an award of attorney fees, cost and expenses for mediation, arbitration and trial or appellate proceedings. Online Booking & Information: The information provided online, although deemed accurate, is not guaranteed, and may be subject to errors, omissions, change of price, or withdrawal without notice. On stays where Rafleys Costa del Sol  is acting as an agent, tenant bounds in the first instance by the Terms and Conditions of the operating company concerned and not those as described in the current agreement. Data Protection: In compliance with the provisions of the General Data Protection Regulation (Regulation 2016/679 of the European Parliament and the Council of April 27, 2016), you are informed of the following points:PURPOSE OF THE TREATMENT: The personal data that you provide to the Treatment Manager will be incorporated into the files of the latter and will be treated exclusively for the provision of the contracted service, for the management of any request, claim, complaint or suggestion made to it as well as for the administrative, accounting and fiscal management of the activity developed by the Treatment Manager.DATA CONSERVATION CRITERIA: The personal data you provide will be kept as long as you maintain the contractual relationship with the Data Controller and as long as they are necessary or pertinent for the purpose for which they were collected or for compliance with the legal obligations of the Data Controller. Treatment. They can be kept for 4 to 6 years, in compliance with the tax and accounting obligations of the person responsible for the Treatment - General Tax Law and Commercial Code.LEGITIMATION: The legal basis for the processing of personal data is the execution of the lease contract established between the client and the Treatment Manager.The interested party will only be obliged to provide the data that are necessary for the provision of the contracted service or to attend to the request, claim, complaint or suggestion made; in the event that it does not provide the necessary data for this, the Treatment Manager can not provide the service or manage the request, claim, complaint or suggestion, and will be exempt from any responsibility in this regard.RECIPIENTS: Data will not be transferred to third parties, except legal obligation or express written authorization of the interested party or his legal representative.RIGHTS: You can exercise the rights of access, opposition, rectification, deletion or cancellation of your data and request the limitation of your treatment, by writing signed and sent by mail to the Treatment Manager at the address indicated in the heading of this document or by email to the email address indicated in the heading of this document.The document by which one of the rights referred to in the previous paragraph is exercised must contain: name and surname of the interested party; photocopy of your national identity document, or your passport or other valid document that identifies you and, where appropriate, the person who represents you, or equivalent electronic instruments; document or electronic instrument accrediting such representation. The use of the applicant's electronic signature exempts from the presentation of photocopies of the DNI or equivalent document.The user also has the right to file a claim with the Spanish Agency for Data Protection, through the official website of the Agency, in the CITIZEN CHANNEL option: http://www.agpd.es/portalwebAGPD/CanalDelCiudadano/ whistleblower / index-ides-idphp.phpBy signing this contract, you consent to the processing of your data by Rafley Costa del Sol, SL in accordance with the provisions of the present clause of this contract.To treat all personal data that you provide, including specially protected data, for the maintenance of the future contractual relationship -leaning of services proper to the exercise of the activity referred to in the heading of this document- and other purposes referred to in the present document.To deliver a copy of the documentation provided to complete the file to: Courts, Tribunals, Public Prosecutor, other intervening third parties, necessary agencies or competent authorities for the provision of the contracted service.We also request your authorization to offer products and services related to those requested and to retain you as a customer.Agreement: This agreement contains the entire agreement of the parties. It may not be changed orally, but only by an agreement in writing signed by the party against who enforcement of any waiver, change, modification, extension, or discharge is sought. RAFLEY COSTA DEL SOL , S.L.CIFB93442549 el legítimo representante de propietario de la propiedad objeto de este contrato, (en adelante el Propietario) y de la otra DON (a) , ciudadano/a de Spain, DNI/pasaporte

*En las propiedades seleccionadas, un huésped puede ofrecer la opción de pagar la parte restante del pago a su llegada. Cuando un huésped elige esta opción, se aplican los siguientes términos y condiciones. El segundo pago debe hacerse a su llegada a la oficina a un gerente de Rafleys Costa del Sol.  Las reservas que no se pagan en su totalidad antes de entrar en la propiedad será cancelada y el pago por adelantado perdido.**Reservas de Airbnb, Tripadvisor. Un depósito de fianza se requiere para cada reserva.Política de cancelación: Si la Parte Arrendataria cancela la reserva, hay una penalización que depende del número de días restantes antes del inicio del período de arrendamiento:   Menos de 30 días: 100% del pago anticipado La cancelación debe ser notificada por escrito. La fecha de cancelación es la fecha en que el anunciante recibe el documento. Si el inquilino termina su estancia antes de la fecha de salida por cualquier motivo, se espera que se pague el precio entero acordado para el arrendamiento.Hora de llegada: La hora de registro es después de las 4:00 P.M. No se recompensará de ninguna manera un check in tardío. Nota: El registro comienza en los horarios indicados, pero no puede garantizarse.Durante la temporada baja, el registro y la hora de salida pueden estar sujetos a disponibilidad y acordarse antes o después de las horas indicadas con previo acuerdo entre ambas partes. La propiedad debe estar limpia e inspeccionada antes de la ocupación.

Hora de salida: Hora de salida es a las 11 am. No se recompensará de ninguna manera el check out temprano. Responsabilidades: A la salida, pedimos a La Parte Arrendataria a dejar la propiedad en el mismo estado general que se encontró. Responsabilidades de salida incluyen lo siguiente: dejar los platos limpios y guardados, sacar toda la basura y depositarla en los contenedores apropiados de la calle, cerrar todas las puertas y ventanas, devolver las llaves al representante de Rafley Costa Del Sol o al Propietario de la vivienda. El incumplimiento de estas responsabilidades puede resultar en cargos adicionales para La Parte Arrendataria.Requisitos de ocupación y edad: La Parte Arrendataria se compromete a mantener el número de personas que ocupan los locales en / o bajo el máximo de personas permitidas. El individuo que hace la reserva debe tener al menos 25 años de edad y debe ocupar la propiedad de alquiler durante todo el período de la reserva. Cualquier infracción de las políticas anteriores dará lugar a la terminación de este acuerdo, incluyendo la posibilidad de desalojo de la propiedad y la posibilidad de pérdida del dinero pagado.Requerimientos de Comportamiento: Hay ciertas normas de comportamiento, basadas en el sentido común, que La Parte Arrendataria se compromete a cumplir con la firma de este contrato. Evitar hacer ruido en las horas de descanso, respetar a los vecinos, respetar las áreas comunes, dejándolas limpias sin basura, ni agua, ni desperfectos, cumplir las normas de la comunidad y seguir las normas de uso de la piscina, en caso las hubiera. Por favor, lean las instrucciones para asegurarse de seguir las recomendaciones del Propietario. Hacer fuego está terminalmente prohibido en España durante el verano. La policía puede implicarse en caso se viole este punto, quedándose el Propietario con el derecho de desalojo inmediato de los huéspedes. Política de fumar: la propiedad objeto del presente contrato es para no fumadores. Cualquier violación de esta política resultará en la terminación de este acuerdo, incluyendo el posible desalojo de la propiedad y la pérdida del dinero pagado. La Parte Arrendataria también será responsable de los cargos adicionales de limpieza.

Agentes con derecho de entrada: En caso de emergencia, los agentes de Rafley Costa del Sol o el Propietario pueden entrar en la vivienda en cualquier momento y sin previo aviso.Indemnización: La Parte Arrendataria por el presente acuerda mantener exento de responsabilidades al Propietario y al Intermediario por lesiones a huéspedes y otras personas y pérdidas de bienes que puedan ocurrir en relación con el uso de los huéspedes de la propiedad.El Intermediario no tiene ningún control sobre el estado de la propiedad, por lo que ante las quejas y solicitudes responderá siempre el Propietario.Ni el Propietario ni el Intermediario están obligados a aceptar para su custodia los fondos, objetos de valor, joyas u otros artículos personales pertenecientes al huésped, ni es Rafley Costa del Sol o propietario responsable de cualquier pérdida en relación con dichos artículos, o para proporcionar seguridad para la propiedad. Rafley Costa del Sol cooperará en el envío de cualquier queja o reclamación de huésped al propietario de la propiedad, pero no estará obligado a corregir cualquier condición o riesgo asociado con la propiedad.Daños: Por favor, informe cualquier daño a su llegada llamando a Rafley Costa del Sol. También, informe por favor de cualquier daño o desperfecto en el momento de la ocurrencia, así que el asunto puede solucionarse antes de su salida. El propietario o el equipo de limpieza comprueban cuidadosamente las propiedades y La Parte Arrendataria será responsable por daños más allá del desgaste normal.

Reglas de Propiedad: Reconozca por favor que La Parte Arrendataria no tendrá derecho a ningún reembolso por cualquier aparato inoperable, incluir por ejemplo, televisión, acondicionador de aire, jacuzzi, o piscina.

Incidencias por Fuerza Mayor: Pueden surgir circunstancias imprevisibles, lo que hace imposible para el Propietario proporcionar la vivienda para el arrendamiento. Tales circunstancias pueden incluir, pero no limitarse a, problemas de organización de calendarios, fallos del equipo, así como un incendio, otro accidente en la propiedad. En caso de tales circunstancias, Rafley Costa del Sol se reserva el derecho de trasladar al huésped a otra propiedad de vacaciones de valor razonablemente comparable, determinada por la discreción de Rafley Costa del Sol cuya determinación será definitiva. La Parte Arrendataria tendrá el derecho de rechazar la vivienda alternativa y realizar cancelación de su reserva sin penalización, excluyendose en ese caso la posibilidad del uso alguno de la vivienda alternativa.En otras circunstancias, como desastres por fuerza mayor, actos de guerra, actos de terrorismo, huracanes, tormentas de viento, incendios u otros sucesos naturales, circunstancias que no sean posibles de prever, es poco práctico para Rafley Costa del Sol poner a disposición de los huéspedes alojamientos alternativos. En tal circunstancia, Rafleys Costa del Sol devolverá el 100% de los pagos recibidos de la Parte Arrendataria.Cambio de Tarifa: Tarifas, descripciones, mobiliario, tarifas de asociación / resort y disponibilidad están sujetas a cambios SIN PREVIO AVISO.Renuncia de términos: No se permitirá ninguna renuncia o cualquier violación de cualquiera de los términos de este acuerdo.

Ley aplicable: Este acuerdo se regirá y se aplicará de acuerdo con las leyes de España. La parte que prevalece en cualquier demanda para hacer cumplir cualquier provisión de este acuerdo tendrá derecho a la adjudicación de honorarios de abogados, costos y gastos de mediación, arbitraje y juicio o procedimientos de apelación. Información e información en línea: La información proporcionada en línea, aunque se considere correcta, no está garantizada y puede estar sujeta a errores, omisiones, cambio de precio o retirada sin previo aviso. En las estancias en las que Rafleys Costa del Sol actúa como agente, inquilinos están obligados en primera instancia por los Términos y Condiciones de la plataforma operadora en cuestión. Protección de Datos de Carácter Personal: En cumplimiento de lo establecido por el Reglamento General de Protección de Datos (Reglamento 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016), se le informa de los siguientes extremos:FINES DEL TRATAMIENTO: Los datos personales que facilite al Responsable del Tratamiento se incorporarán a los ficheros de éste y serán tratados exclusivamente para la prestación del servicio contratado, para la gestión de cualquier petición, reclamación, queja o sugerencia que realice ante el mismo así como para la gestión administrativa, contable y fiscal de la actividad desarrollada por el Responsable del Tratamiento.CRITERIOS DE CONSERVACIÓN DE LOS DATOS: Los datos personales que proporcione se conservarán mientras mantenga la relación contractual con el Responsable del Tratamiento y mientras sean necesarios o pertinentes para la finalidad para la que han sido recabados o para el cumplimiento de las obligaciones legales del Responsable del Tratamiento. Podrán conservarse de 4 a 6 años, en cumplimiento de las obligaciones fiscales y contables del responsable del Tratamiento –Ley General Tributaria y Código de Comercio-.

LEGITIMACIÓN: La base jurídica del tratamiento de los datos personales es la ejecución del contrato de arrendamiento de servicios establecido entre el cliente y el Responsable del Tratamiento.

El interesado únicamente estará obligado a facilitar los datos que sean precisos para la prestación del servicio contratado o para atender a la petición, reclamación, queja o sugerencia que realice;  en el supuesto que no facilite los datos necesarios para ello, el Responsable del Tratamiento no podrá prestar el servicio o gestionar la petición, reclamación, queja o sugerencia, y quedará exento de cualquier responsabilidad al respecto.

DESTINATARIOS: No se cederán datos a terceros, salvo obligación legal o autorización expresa y por escrito del interesado o su representante legal.

DERECHOS: Puede ejercer los derechos de acceso, oposición, rectificación, supresión o cancelación de sus datos así como solicitar la limitación de su tratamiento, mediante escrito firmado y dirigido por correo postal al Responsable del Tratamiento al domicilio indicado en el encabezamiento del presente documento o mediante correo electrónico a la dirección de correo electrónico indicada en el encabezamiento del presente documento.

El escrito por el que se ejercite alguno de los derechos referenciados en el párrafo anterior deberá contener: nombre y apellidos del interesado; fotocopia de su documento nacional de identidad, o de su pasaporte u otro documento válido que lo identifique y, en su caso, de la persona que lo represente, o instrumentos electrónicos equivalentes; documento o instrumento electrónico acreditativo de tal representación. La utilización de firma electrónica identificativa del solicitante exime de la presentación de las fotocopias del DNI o documento equivalente.

El usuario también tiene derecho a presentar una reclamación ante la Agencia Española de Protección de Datos, a través de la página web oficial de la Agencia, en la opción CANAL DEL CIUDADANO: http://www.agpd.es/portalwebAGPD/CanalDelCiudadano/denunciasciudadano/index-ides-idphp.php.Mediante la firma de este contrato, Usted consiente el tratamiento de sus datos por parte de Rafley Costa del Sol, SL en concordancia con lo expuesto en la presente cláusula del presente contrato.A tratar todos los datos de carácter personal que le facilite, incluidos los datos especialmente protegidos, para el mantenimiento de la futura relación contractual –arrendamiento de servicios propios del ejercicio de la actividad referida en el encabezamiento del presente documento- y demás finalidades referidas en el presente documento.A entregar copia de la documentación facilitada para cumplimentar el expediente a: Juzgados, Tribunales, Ministerio Fiscal, otros terceros intervinientes, organismos  necesarios o Administraciones competentes para la prestación del servicio contratado.

Asimismo solicitamos su autorización para ofrecerle productos y servicios relacionados con los solicitados y fidelizarle como cliente.Acuerdo íntegro: Este acuerdo contiene el acuerdo completo de las partes. No puede ser cambiado oralmente, sino solamente por un acuerdo por escrito firmado por la parte contra quien se solicita la aplicación de cualquier renuncia, cambio, modificación, extensión o descarga. La Parte Arrendataria no puede asignar o transferir este Acuerdo.* Todas las políticas y procedimientos están sujetos a cambios y / o actualizaciones sin previo aviso.
